Shrewsbury Auction Centre is shown on the plan to the rear of the catalogue.

The nearest motorway connection is the M54 as shown on the plan.

 

VAT

The majority of lots will attract VAT at 20%, all lots from unregistered vendors

will not attract VAT. For further details, please ask at the auctioneer’s office.

 

 

Electrical Items

All electrical items that are warranted are tested by a qualified electrician & a

certification stamp placed on the plug prior to sale. Plugs are removed from

any items that are not warranted.

If you are a purchaser of an electrical item which does not meet these criteria

then do not use the item & please inform the Auctioneers where this problem

will be rectified.

 

Loading

Assistance loading will be available & unloading on the day of sale. No

responsibility will be accepted by the auctioneers for any damages sustained to

any lots. A loading ramp is available for use by vendors & purchasers. No

liability can be accepted by the Auctioneers for any damages sustained to any

Lots whilst in use.

 

Transport

The auctioneers will be pleased to assist in organising transport. Local

contractors will be in attendance on the day of the sale.

 

Money Laundering Regulations 2003

In order to comply with the above regulations, we are no longer able to accept

cash payments for sums in excess of £7500. This includes single payments

amounting to this sum or multiple payments totalling £7500.Insurance of Goods

Vendors & purchasers are reminded that they are solely responsible for

insurance of items whilst they are st&ing in our yard. If required, you must

make your own insurance arrangements.

 

Hour, Milometer & Kilometre Readings

Any hour, milometer or kilometre readings recorded on any Lot or mentioned

in this catalogue cannot be guaranteed unless stated otherwise.

 

Presentation of Lots

The Auctioneers will use every endeavour to ensure that all Lots listed in the

catalogue are presented for sale. The Auctioneers will not entertain any claim

for expenses incurred in abortive attendance at the sale.

 

Viewing

The Lots may be viewed on the day of sale from 8.00 a.m. & on the day before

the sale from 8-30am to 5.00 p.m. Please note that some items will not

arrive until the day of sale.

 

RICS Client Money Protection Scheme

All financial transactions within this market are conducted with the

Auctioneers acting as principal. Sale proceeds are not paid into a client

bank account and, consequently, the RICS Client Money Protection

Scheme (CMPS) will not apply to protect the vendor.

 

Payment Terms

All accounts must be settled on the day of sale, no credit will be

available. Any prospective purchasers unknown to the auctioneers and wishing

to pay by cheque must make the following arrangements at least 7 days prior

to the sale:

1. Inform your bank manager that you wish to pay by cheque. Tell them the

likely amount that you intend to spend, and instruct him to contact us via

email reception@hallsgb.com or fax 01743 442815 in order to accept your

cheque.

 

1.Business and Commercial Debit Cards will incur a 2% Fee

2. Credit cards are no longer accepted .

 

Misrepresentation Act 1967

The Auctioneers for themselves and the vendors, whose agents they are, give

notice that the descriptions in this catalogue, although believed to be correct,

are not guaranteed as to age or year. Prospective purchasers must

satisfy themselves, by inspection or otherwise as the details of each lot.

Power Take Off Drive Shafts

Vendors: all PTO drive shafts must be securely attached to the

respective implement or correctly labelled with the Lot number and place in

the Auctioneers’ Office. It will be presumed that all PTO drive shafts are not

available to purchasers unless a statement is given to the contrary at the time

of the sale.

 

Removal of Items

Purchasers and vendors are reminded that a maximum time of 7 days is

allowed for the removal of all items entered and purchased in this sale.

All online purchasers will pay buyers premium at 5% +VAT on the hammer price of each lot purchased.

 

Payment

1. Inform your Bank Manager that you wish to pay be cheque. Tell them the likely amount you intend to spend and instruct your Bank Manager to inform us by Fax 01743 443759 or e-mail rececption@hallsgb.com that it is in order to accept your cheque.

 

2. Arrange with your bank manager for the issue of a guaranteed cheque to be issued.

 

3. Debit cards accepted with a £1 fee for transactions under £25

 

4. Credit cards are no longer accepted

 

Collection

All items must be removed from the sale site within 3 days. The auctioneers reserve the right to charge storage for any uncollected items.

Interested parties are encouraged to contact the auctioneers prior to bidding to request further information regarding any lots they are interested in bidding on.

CONDITIONS OF SALE

1 The highest bidder shall be the purchaser and if any dispute shall arise between two or more bidders, the lot in dispute is to be put up again at the sum last bid or the Auctioneers may declare the purchaser.

2 The bidding is to be ruled by the Auctioneers who may, without giving any reason, refuse to accept the bid of any person.

3 No person shall retract a bid without permission of the Auctioneer, who reserves the right to himself refuse a bid, and also the right of withdrawing any lot or lots from the sale.

4 The bidder may advance less at a bid than the sum named from time to time by the Auctioneers.

5 The purchaser must declare their name and address and if required to, pay the Auctioneer or his clerk the amount of purchase money immediately on the fall of the hammer. In default of which the lot or lots shall be offered again and resold, and under no circumstances must any lot be removed without first obtaining a pass from the clerk.

6 The Auctioneers reserve the right to charge Interest and Compensation on overdue accounts as allowed in the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002.

7 Title to each asset sold will only pass on payment in full by the purchaser.

8 The Auctioneers reserve the right of deviating from the catalogue either by amalgamating or dividing the lots, as circumstances may require and also by deviating from the order of sale.

9 The lots are to be under the immediate care of the purchasers who must take the same with all faults, imperfections and errors of description (if any) and remove the same at their own expense and risk, and no purchaser shall be allowed to remove lots from the premises until the whole of the purchase money is paid.

10 All statements contained in this catalogue as to the authenticity, genuiness, date, age, condition or quality of any lot are statements of opinion and are not taken as or implying, statements or representations of fact.

11 Intending purchasers must satisfy themselves by inspection as to all such matters as to the physical description of any lot.

12 Neither the Vendor(s) of any lot nor the Auctioneers make or give any representation or warranty as to fitness for purpose or the quality of lots sold.

13 If any lots are described at the time of sale as ‘in working order’ such lots shall have no defect which renders them incapable of the reasonable work for which they are intended and they must be capable of performing such work.

14 The purchaser is to make good any damage done to the premises by the removal or otherwise of any lot or lots.

15 The purchaser shall not be entitled to any right of “Set Off” against the Vendor or the Auctioneer.

16 In the case of lots upon which there is a reserve, the Auctioneers shall have the right to bid on behalf of the seller.

17 Upon failure to comply with the above conditions, the uncleared lots will be re-sold either by public or by private sale and the deficiency (if any) and all expenses attendant thereon shall be made good by the defaulters at this auction, who shall have no claim for any surplus that may arise.

18 The Auctioneers may rescind any sale within 3 hours of the final lot being sold if the lot has been sold under reserve. In the event of such rescission, the purchase price or any part already paid by the Buyer shall be repaid but the parties and the Auctioneers shall be under no further liability to each other.

 

COMPLIANCE WITH ROAD TRAFFIC ACTS

19 The purchaser of any vehicle or trailer is responsible for complying with all legal requirements as to the construction and the use of such vehicle or trailer and for obtaining all certificates, permits or other authorisations necessary before such vehicle or trailer can be used on the road.

 

HEALTH & SAFETY AT WORK ACT 1974 AND ALL OTHER ACTS & REGULATIONS APPLICABLE TO FARM SAFETY

20 The purchaser of any lots is responsible for complying with all legal requirements as to the safe use of lots purchased at the sale and shall ensure compliance with all relevant legislation relating to the safe use of such lots.

 

TRADES DESCRIPTION ACT 1968

21 The vendor is reminded that under the terms of the Trades Description Act 1968 the Vendor of any lots to which a false description is applied may be guilty of a criminal offence punishable by fine or imprisonment.

 

ONLINE PURCHASERS

22. The auctioneers reserve the right to not accept an online bidder. All potential online bidders must be accepted by the auctioneers whose decision will be final. Online purchasers will be required to pay a2% surcharge + VAT. The auctioneers do not accept any responsibility for descriptions contained within their catalogue.
