BIDDING ENDS:

• Successful bidders will be notified by email after the sale.
• MAXIMUM BIDS: If more than one maximum bid is placed of the same amount, the maximum bid placed first will be considered the highest bid and a further bid will need to be placed to take the lead. Bidders are notified by an automated message which appears on their screen.
• IMPORTANT: When bidding, do not forget to ‘REFRESH’ your screen to ensure you are aware of current bids.
INSTRUCTIONS FOR BIDDING:
• All bidding will be through the Bidspotter & i-Bidder website, you must pre-register with them in order to bid including registering a valid credit or debit card
• In the event of a bid being received within 10 minutes of the scheduled closing time, the bidding period on that lot will automatically extend by a further 10 minutes and for a further 10 minutes for any bid received thereafter.
BUYERS PREMIUM:
• The purchaser will pay a buyers premium of 15% plus VAT, which will be charged on all lots unless indicated otherwise.
• The premium is not negotiable and will be paid by all buyers
• VAT on buyers premium is payable on buyers premium where goods are exported in all instances.

• COMPUTER SOFTWARE: Due to the Data Protection Act, all software and data (including operating system) will be removed from computers prior to selling (unless otherwise stated).
• What you see in the photo is what you are bidding on (unless stated otherwise or an image is used for illustration purposes only), no other accessories/peripherals come with any of the lots unless they are pictured with them, this includes power cables / adapters, manuals, etc.
CLEARANCE TERMS AND ARRANGEMENTS
• All lots must be removed between Thursday 7th January 2016 and Thursday 14th January 2016 (Weekdays only). Storage charges will be applied if goods are not cleared within this time frame (as per our terms and conditions).
• The premises will be open from 9.45 am to 5.00 pm, Weekdays only.
• Purchasers are responsible for making their own collection arrangements, we do not offer a courier or delivery service but recommend www.parcel2go.com for parcels/packages and www.palletonline.co.uk for pallets.
• Forklift is available onsite.
• PACKAGING: If required we can package up items at an additional cost, if you require items packaged you will need to contact us to let us know, items will not be packaged if we are not contacted.
•3RD PARTY / COURIER COLLECTION: If you are using a 3rd party to collect your items will need to arrange for the items to be packaged first, once we have confirmed that the items are ready to be collected you will then need to inform us when your courier is due to collect. You MUST ensure that the collecting party state your BIDDER ID when collecting, without this the items WILL NOT BE RELEASED, this is for the security of your items.
VAT on Goods Destined for Export:
• All purchasers intending to export their purchases will be initially charged VAT until satisfactory evidence of export is received by Total Business Care (the goods must be exported in accordance with regulations under “Indirect Export”). Where satisfactory evidence is not provided, goods will be subject to UK VAT and no VAT refund will be applicable. There will be a 20% (of the VAT amount value) administration charge deducted from any VAT refund due. We are unable to refund the VAT on the buyers premium in any circumstances.

Please read the following carefully as a sale at auction is not a consumer sale under the Sale of Goods act.
All other conditions as may be lawfully excluded are hereby excluded.
(1)Inspection, Description & Auctioneer’s responsibilities.
The Auctioneers have relied upon descriptions furnished by Vendors in the preparation of this catalogue. The Auctioneers are not therefore responsible for the descriptions of lots shown in this catalogue, nor does this catalogue form a part of the contract of sale.
Potential buyers are invited to inspect the goods on sale to their satisfaction prior to bidding for any item.
The Auctioneers act as agents only and cannot be held responsible for any default by Purchaser or Vendor.
The Auctioneers, while using their best efforts to describe equipment in this catalogue accurately and to publish any alteration or amendment to the description of a lot on their catalogue supplement accept no liability in the event that an item is misdescribed in the catalogue as a consequence of the vendor supplying incorrect information or otherwise.
(2)Warranty
No warranty is given or implied on any of the lots offered in this catalogue. All lots are sold with all faults and errors of description and neither the vendor nor the Auctioneer are responsible for the authentically, provenance attribution of ownership, date, age, condition or quality of any lot. All statements in the catalogue as to any such matters are statements of opinion and not to be relied upon as statements or representation of fact. Intending purchasers must satisfy themselves by inspection or otherwise to all such matters and to the physical description of any lot. (3)Care of Goods:
While the auctioneers will exercise every reasonable care in the supervision, transport & storage of goods, goods are held at the responsibility & risk of the vendor until the fall of the hammer, and are the responsibility & risk of the purchaser from the fall of the hammer. Buyers who are unable to clear their purchases from the sale site on the day of the sale are advised to make their own insurance arrangements in respect of goods bought at the auction.
(4)Bidder Registration
Bids will only be accepted from bidders who have obtained approval from the Auctioneers.
(5) Buyers Premium
A buyers premium of 15% + VAT will be charged on all lots. The seller can place a reserve on any lot and the auctioneer shall have the right to bid on behalf of the seller.
(6) Conduct of Sale
Normal auction procedures will be followed. The highest bidder will be the purchaser.
Bidding will proceed in such increments as the auctioneer dictates. The Auctioneers reserve the right to bid on behalf of persons absent from the sale room.
The highest bidder shall be the purchaser and no person shall retract bidding. The vendors reserve the right to bid.
All buyers are deemed to have read, understood and accepted our terms and conditions as confirmed in the catalog. All buyers’ accounts are to be settled within 48 hours.
The purchaser shall give their name and address and contact details.
No bidder shall advance less than a sum to be named by the auctioneer, and he has the right to refuse any bid.
The auctioneer reserves the right to refuse any bidding or to withdraw any lots from the sale.
(7)Clearance of Purchases
The premises will remain open for clearance of purchases for 7 days after the close of bidding. Buyers may settle their accounts and remove their purchases at any time during the course of the auction, but this facility is offered at the discretion of the auctioneers, and goods must be removed in such a fashion as not to disrupt the progress of the business.
(8)International Buyers
All International buyers or buyers intending to export goods bought at auction must pay the VAT upfront until such point that we receive sufficient documentation to prove that the goods has left the UK within the regulations set by HM Revenue & Customs. Please note that VAT on the buyers premium will not be refunded only on the hammer price. No VAT refund will be made until we confirm that the documents provided have been approved by HM Revenue & Customs as sufficient evidence (for more information on documents required please visit the HM Revenue & Customs website).
(9)Collection of goods
Goods which are not collected on sale day will be removed to the auctioneer’s storage facilities.
All lots must be taken and cleared away at the purchaser’s expense between the hours of 9:30 am – 5:00 pm Monday-Friday within 7 days of the end of the auction
Upon failure to comply with the above conditions, or any of the purchasers neglecting or refusing to clear away his or her lot(s) within the permitted time the lots shall be re-sold by public or private sale and the deficiency (if any) by such second sale, together with all the charges attending the same will be the responsibility of the defaulting buyer. The condition is without prejudice to the right of the auctioneer to enforce the contract made at this sale, without such re-sale if he thinks fit.
Goods purchased at the sale and not cleared within the permitted time, will be charged at the rate of £5.00 per lot per day. Storage for vehicles will be charged at the rate of £25.00 per vehicle per day.

Cheque goods can only be collected upon confirmation from the bank that funds have cleared.
At the Auctioneer’s discretion a cheque for any amount with the Auctioneers reserving the right to retain the goods for which that cheque represents payment pending clearance.
N.B. Cheques will not be assumed to be cleared until 5 working days after their receipt by the Auctioneers.
Any delay in cheque clearance will render the issuer of that cheque liable for our storage fees and for any bank charges incurred in representation. Any cheques that fail to clear will be charged at the rate of £25 per cheque. All invoices that are not settled within the permitted time will be charged interest of 12.5% per annum from the defaulting date.
