Welshpool Livestock Sales Ltd offers an online bidding service via www.i-bidder.com and www.BidSpotter.co.uk for bidders who cannot attend the sale.

In completing the bidder registration on www.i.bidder.comand and www.BidSpotter.co.uk and providing your debit card details and unless alternative arrangements are agreed with Welshpool Livestock Sales Ltd :

1.                 authorise Welshpool Livestock Sales Ltd , if they so wish, to charge the debit card given in part or full payment, including all fees, for items successfully purchased in the auction via www.i.bidder.com or www.BidSpotter.co.uk and

2.                 confirm that you are authorised to provide these credit card details to Welshpool Livestock Sales Ltd through www.i.bidder.com or www.BidSpotter.co.uk and agree that Welshpool Livestock sales Ltd are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.

REMOVAL OF BOUGHT AND UNSOLD LOTS

 

It is IMPERITIVE that all bought and unsold items are removed from the sale premises by 12 noon on the day after the sale..

 

 

 

ALL ITEMS ONCE SOLD OR LEFT ON THE SALE FIELD ARE LEFT AT THE OWNERS RISK AFTER THE FALL OF THE HAMMER.

 

 

 

ELECTRICAL ITEMS

 

All portable electrical items must be accompanied with a valid Electrical Safety Test Certificate, as we can no longer accept items without a valid certificate.

 

 

 

BIDDING NUMBER

 

 

A Buyers Number system will be in operation at this sale with ALLprospective purchasers whether known to the Auctioneers or not having to register their name, address, phone number and two forms of identification in order to obtain a Buyers Number.

 

 

 

LOTS IN CATALOGUE

 

Purchasers travelling long distance are advised to ring to check whether lots they are interested in are still available for sale as vendors circumstances sometimes change.

 

 

PAYMENT

 

 

All purchases shall be paid for on the day of the sale direct to the Auctioneers before removal and no lot to be removed without the written authority of the Auctioneers. Cheques will not be accepted unless prior arrangements with the Auctioneers have been made. Where a Purchaser defaults in payment, the Auctioneers reserve the right to re-sell the lot and to charge the Purchaser to complete his purchases. The Auctioneers reserve the right to charge interest at the current bank overdraft rate of any outstanding accounts from the day of sale unless special arrangements have been made with the Auctioneers in this respect.

 

Transfers of purchases will only be recognised at the sole discretion of the Auctioneers.

 

Every Purchaser shall leave his full name and address at the Auctioneers’ office whether he intends to remove his purchases on the day of the sale or not

 

Cash (maximum £10,000). Debit card. Telegraphic transfer, bankers draft, building society cheque. Telegraphic transfer account details can be obtained from the auctioneers (WLS, tel: 01938 553438). Lots will only be released upon receipt of cleared funds. Cash payments in excess £10,000 cannot be accepted in accordance with the Money Laundering Regulations 2003. The auctioneers reserve the right to request the payment of a deposit, in accordance with the conditions of sale.

 

Buyers seeking to finance their purchase through a finance company should make such arrangements well in advance of the sale day to ensure that they can make payment in accordance with the conditions of sale.

NEW PURCHASERS

 

 

Any prospective purchaser unknown to the Auctioneers and wishing to pay by cheque must make the following arrangements by no later than 5 working days prior to the sale.

 

 

 

  1. Inform your own Bank Manager that you wish to pay by cheque. Tell him the maximum amount that you are likely to spend and ask him to instruct us directly by fax letter that it will be in order to accept your cheque.

 

 

 

  1. Arrange with your Bank Manager for the issue of guaranteed cheque to be brought with you.

 

 

MISREPRESENTATION ACT 1967

 

 

The Auctioneers for themselves and the vendors whose agents they are, give notice that the descriptions in this catalogue although believed to be correct are not guaranteed to age or year. Prospective purchasers must satisfy themselves, by inspection or otherwise as to the details of each lot.

 

 

 

DESCRIPTION

 

The descriptions are supplied by the Vendors who alone are responsible for details and the Auctioneers will not be answerable in respect of any errors which may occur in the catalogue. The Auctioneers may make any intimation of any alteration or modification of the catalogue description of any lot immediately before asking for bids. The Auctioneers shall be the sole and exclusive judge of the fact of such intimation and the terms in which it is made. Each lot is sold with all faults, imperfections and errors of description and the Auctioneers are not responsible for the authenticity, attribution, genuiness, origin, authorship, date, age, period, condition or quality of any lot.

 

 

POWER TAKE OFF DRIVE SHAFTS

 

 

Vendors must ensure that all P.T.O shafts are securely attached to the machine or taken off and placed at the Auctioneers office and labelled with a Lot number.

 

However some items may have no P.T.O shafts available for them. If any purchaser is unsure he should ask the Auctioneer at the point of sale.

 

 

 

WARRANTY

 

a) Unless a warranty is given in the catalogue or at the time of sale, the lots are sold as they stand with all faults, imperfections and errors of descriptions or otherwise. The purchaser shall be deemed to have inspected the lots he buys.

 

b) Vehicles and trailers may not be immediately roadworthy or may be of such design as will not, without alterations, comply with the provisions of Road Traffic Acts of Regulations. The purchaser shall undertake to comply with such Acts and Regulations.

 

c) Implements and machinery may not immediately comply with the provisions of Safety Health and Welfare Acts and Regulations. The purchaser shall undertake to comply with such Acts and Regulations.

 

d) Vendors must comply with the Trade Descriptions Act 1988 and be capable of substantiating all claims, descriptions, quality, manufacture and composition etc of their lots.

 

e) Items described as being in working or running order or condition shall have no defect which renders it capable of the reasonable work for which it is intended and must be capable of performing such work.

 

f) Items described as being in good working or running order or condition shall be mechanically sound and capable of performing the work for which it is intended.

 

g) No items shall be returnable for any description or warranty other than that affecting its working, running or mechanical condition.

h) Items described as straight from work, recently overhauled etc or similar description shall be deemed a warranty and be capable of performing the work for which it is intended

 

 

 

INSTRUCTIONS TO BID

 

 

The auctioneers will be pleased to accept instructions to bid on behalf of buyers unable to attend the sale. Instructions to bid must be by written authority. Please contact the auctioneers for details, (WLS, tel: 01938 553438). The auctioneer will only accept payment from and permit removal of lots purchased by the purchaser successfully bidding at the sale.

 

The highest bidder shall be the Purchaser and any dispute which arises shall be settled by the Auctioneer who shall regulate the bidding and have the right to refuse a bid.

 

 

 

COMPLAINTS

 

a) If the Auctioneer receives a complaint in writing by 5.00pm on Monday following the date of the sale the net proceeds of sale shall be held by the Auctioneers and they shall be under no obligation to account to the Vendor until they are satisfied that such dispute has been settled.

 

b) No lot shall be subject to the complaints procedure unless paid for on the day of the sale and any such payment subsequently stopped or dishonoured shall not constitute payment.

 

c) The Auctioneers shall have the right to appoint a person to act as arbitrator subject to the Arbitration Acts as modified by these conditions of sale. The Arbitrator’s decision shall be final and binding on all parties.

 

d) The Auctioneers act solely as agent between the Vendor and Purchaser and in the event of a dispute or refusal to pay or non-payment on the part of the Purchaser, they may, at their discretion, annul and cancel the sale of such lot or lots.

 

 

 

VAT

 

a) Value Added Tax at the standard rate will be charged on all lots except those announced at the time of sale.

 

b) In the case of overseas purchasers from EC countries, they will be required to supply the Auctioneers with their VAT/FISCAL number in order that the items may be invoiced at zero rate for VAT purposes. Where the number is not made available or where the purchaser is not VAT registered, VAT at the standard UK rate will be charged in addition to the purchase price on all relevant lots.

 

c) Overseas purchasers from non EC countries will be required to pay a VAT deposit equivalent to the standard UK rate of VAT, and such amount will refunded to the purchaser if the Auctioneers receive within 1 month of the sale, a bill of landing or certificate of shipment as proof of shipment of the lots overseas, failing which the VAT deposit will be paid over to the vendors as VAT.

 

 

 

LOADING/UNLOADING VEHICLES

 

A loading vehicle is available free of charge to assist with the loading/unloading of lots and a loading ramp is also available. These facilities are provided entirely at the risk of the Vendor or Purchaser who must be responsible for supervision and the Auctioneers accept no liability whatsoever. Loading will only be undertaken in daylight hours for safety reasons.

 

 

 

EXCLUSION OF LIABILITY:

 

The Auctioneers shall not be liable for any expenses, loss, claim or proceedings in respect of any loss or damage whatsoever to any property real or personal (including all lots) whether incurred before, during or after the sale. The Auctioneers shall not be liable for any expense, loss, claim or proceedings in respect of personal injury to or death of any person arising out of or in the course of or caused by the sale, except to the extent that the same is due to the negligence of the Auctioneers, their Servants or Agents.

Sale 1 – 5% + vat, Minimum of £1/ lot + vat

 

Sale 2 – 5% + vat, Minimum of £2/ lot + vat

 

Sale 3 – 2.5% + vat, Minimum of £5/ lot + vat, maximum of £250 per lot + vat

  1. It is preferable if dogs are not brought to the sale but if so please keep dogs under control at all times

     

 

 

 

  1. A responsible adult must accompany persons under the age of 18 at all times

     

 

 

 

  1. Do not enter areas that are fenced or taped off

     

 

 

 

  1. There may be uneven ground, tripping hazards and slippery surfaces around the sale venue. Take care when moving around the site and ensure you wear appropriate footwear

     

 

 

 

  1. Take care when inspecting sale items. Items may move. Vehicles and machinery may only be operated with the authorization of the auctioneers. No persons under 16 will be permitted on any vehicle or machine

     

 

 

 

  1. Purchasers and their agents are under a duty of care to all others when removing items from the sale and should use appropriate protective equipment and clothing. All transport and lifting equipment must conform to current Health and Safety Executive and Road Traffic Act requirements

     

 

 

 

  1. In case of emergency all visitors should assemble in the visitors car parking area
